Terms of use.

The operator and this agreement

ATAI.ca is operated by LUMINOVA AI TWIN INC. ("ATAI", "we", "us"). These Terms govern access to our website, subscriptions, software, account features and related content. Read them with our Privacy Policy, Risk Information and the product description and order details provided at checkout. Contact support@atai.ca with questions or to request a copy.

By using the services, you agree to these Terms. A purchase additionally requires an affirmative acceptance of the version shown at checkout. If you do not agree, do not use or purchase the services. You must be of legal age to enter this agreement where you live, have authority to use any connected account, and comply with the laws and broker rules that apply to you.

Educational tools; your independent decisions

ATAI supplies educational market information, analytical software, signals and scenarios, chart analysis, news commentary, trading journals, performance reviews and Expert Advisors. These tools help you examine information. We do not assess your personal financial circumstances, investment objectives, experience or risk tolerance to provide personalised recommendations or determine whether a trade, strategy, broker or investment is suitable for you.

Content, BUY/SELL labels, entry and exit levels, scores, AI outputs and support replies are not personal investment, financial, legal or tax advice, or an instruction to transact. Access does not create an investment advisory, fiduciary, portfolio-management or brokerage relationship. Consider independent advice from an appropriately qualified professional when needed.

Your trading capital stays with your chosen broker or custodian. ATAI does not receive, hold or have custody of your trading capital. We do not manage your trades or portfolio on a discretionary basis or operate your brokerage account on your behalf. Payments for ATAI products and subscriptions are service fees, not funds deposited with ATAI for investment or trading.

You decide whether to use a signal or activate an Expert Advisor. The final decision to act on a signal, place a trade, install or enable an EA, select its settings, or continue or stop using it is yours. Once you enable an EA, the software may automatically open, manage and close positions according to its programmed strategy without separate approval for each order. You remain responsible for choosing and monitoring that automation and for your trading decisions and their resulting profits or losses, subject to the mandatory rights and legal obligations preserved in these Terms.

Trading risks and no promised profit

Trading in forex, metals, cryptocurrencies, derivatives and other financial markets involves substantial risk. You may lose part or all of your trading capital. With some leveraged products, losses can exceed your deposit if your broker and applicable rules do not provide negative-balance protection. Never treat a minimum capital requirement, target, score, risk control or advertised drawdown as a guarantee or a maximum possible loss.

No profit, positive return, capital preservation, win rate or income is promised or guaranteed. Past performance does not guarantee future results. A period of profit does not establish that a strategy will remain profitable. You must evaluate whether trading is appropriate for your circumstances and use capital whose loss you can bear.

You make and remain responsible for your own trading and investment decisions, including whether to act, position size, leverage, settings, entry and exit timing, monitoring and risk management. You bear the resulting profits, losses, charges and tax obligations. Reliance on our tools does not transfer those decisions or their market risk to ATAI.

Performance reports, examples and simulated results

Backtests, simulations, model results, demo-account results and live-money results are different types of evidence. Read the account type, reporting period, source, update time, costs and calculation method. Demo execution may differ materially from live trading; historical simulations may omit real slippage, liquidity, latency, spread changes, financing or outages.

Journal measures may use closed trades, equity snapshots or a selected sample. A closed-trade drawdown does not capture all floating losses, and sampled equity may miss an intraperiod low. Deposits, withdrawals, partial closes, missing history and account currency can affect interpretation. A displayed win rate is not the probability that your next trade will win.

External performance links, including Myfxbook, provide additional context subject to that provider's availability and methodology. A listing, account connection or verification badge is not a promise of profit, an endorsement by that provider, or a guarantee that a customer's settings, broker or results will match.

Expert Advisors and trade execution

An Expert Advisor may submit, modify and close orders when you install it, enable trading and grant permissions in your terminal. Understand the specific strategy before enabling it. Automated trading can rapidly accumulate exposure; grid, averaging and hedging strategies can experience large drawdowns and liquidation. Demo-test the software and verify symbol, account type, capital, timeframe, licence and broker requirements.

The software may be used on supported demo or live accounts, subject to its licence requirements, your broker’s rules and applicable law. Whether to use it with real money is your independent decision. The Expert Advisor licence agreement sets out the permitted use and software responsibilities.

You acknowledge that trading outcomes are uncertain and accept the market risks associated with your trading decisions. These risks include adverse price movements, leverage, accumulated exposure, spread widening, slippage, gaps, commissions, financing costs and liquidation.

Software defects, delayed or rejected orders, inaccurate data, connection failures and interruptions involving terminals, brokers, VPS providers or licensing services may affect operation. Risk controls, profit targets and stop orders cannot guarantee execution or prevent every loss.

A trading loss or an inaccurate forecast does not, by itself, establish that ATAI breached this agreement or that compensation is due. This does not prevent a customer from reporting a defect or exercising an applicable legal remedy.

Broker rejection, execution delays, gaps, spread widening, commissions, swaps, slippage, margin rules, terminal or VPS failures, disconnections and programming defects can change outcomes. Targets, trailing controls and news or session holds may not protect capital. A hold on new baskets may leave existing positions under management. Disabling a terminal, an EA or a subscription may not close positions already open at the broker.

You remain responsible for monitoring orders and positions with your broker, maintaining the required terminal or VPS connection and deciding whether manual intervention is needed. No service guarantees continuous execution, a particular closing price or simultaneous closure of all positions.

Data, signals and artificial intelligence

Quotes, calendars and calculations depend on external sources and may be incomplete, delayed, incorrect or unavailable. Markets and brokers can use different prices, sessions and timestamps. Historical data shown during market closures is reference information, not a fresh entry instruction. Alerts and browser or email notifications are not guaranteed to arrive before an event or price move.

AI-generated analysis can contain errors, omissions or unsupported interpretations. Check important claims against source data and your own broker. A trading review is not a psychological diagnosis, and a profitable or losing outcome alone does not establish the quality of the decision that produced it. Do not provide confidential third-party information that you are not authorised to share.

Your account, connections and licence

Provide accurate information, protect your credentials, use available account-security features and promptly report suspected misuse. You are responsible for activity you authorise through your account. Never send passwords, recovery phrases or private keys through support messages.

Connect only trading accounts you own or are authorised to use. For journal imports, use the Investor or read-only password requested by the connection form. Journal access is for retrieval and analysis, not order execution. Disconnecting stops new imports and removes the stored connection credential; it does not delete existing journal history or change positions at your broker.

A purchase grants a limited, non-exclusive right to use the purchased service for its stated term and limits. Account binding, permitted account changes, device or account limits and supported platforms follow the product page and order. Do not resell, share or bypass paid access or licence restrictions. Mandatory legal rights and lawful exceptions remain unaffected.

Prices, payment and access periods

Prices are displayed in USD unless expressly stated otherwise. Checkout shows the selected product, access period, applicable discount and final amount. A fixed-term purchase does not automatically renew. Buying access pays for the service, not a promised financial outcome. New prices do not retroactively change a completed fixed-term order.

Card subscription renewals

When automatic renewal is offered, monthly and three-month card subscriptions require your express agreement at checkout. You authorise the displayed first payment and the regular renewal amount every calendar month or every three calendar months until cancelled. Checkout discounts apply only to the first payment. We do not silently enrol existing one-time purchases.

You can stop future charges in Account → Billing & renewals before the next billing date. Cancellation takes effect for the next renewal and does not remove access already paid for or automatically request a refund. If a charge has already been processed, cancellation stops the following charge. A failed renewal does not extend access; payment may be retried by the payment provider, and you may need to complete authentication. Contact support if a cancellation is awaiting provider confirmation. Cryptocurrency and ATAI Coin purchases remain fixed-term and are not automatically debited. Mandatory consumer rights remain unaffected.

Card payments are handled through Stripe when offered. For cryptocurrency, use the exact asset, network, destination, amount and any required tag shown on the invoice before its expiry. Conversion quotes may expire, network fees are separate where indicated, and blockchain confirmation or payment checks may delay activation. Do not send funds on a different network.

Automated detection does not guarantee that every transfer can be matched. If payment is delayed, incorrect or duplicated, contact support with the order reference; a transaction ID may be requested for investigation. We cannot guarantee recovery of a transfer to a wrong address, network or destination tag, but will review issues affecting an ATAI order. We never ask for wallet recovery phrases.

Cancellation, service problems and statutory rights

Contact support@atai.ca promptly about an incorrect purchase, failed activation, duplicate payment, prolonged outage or cancellation/refund request. Include the order reference and describe the issue; do not include credentials. We review the order, service supplied and the remedies required by applicable law. Losses from trading or dissatisfaction with market outcomes are not, by themselves, evidence that a paid service was not supplied.

Nothing in these Terms removes a cancellation, refund, chargeback, warranty, remedy or other consumer right that cannot lawfully be excluded. Cryptocurrency payment or use of loyalty rewards does not waive mandatory rights. Where a refund is due, the amount, method and any unavoidable network requirements will be confirmed with you rather than assuming a blockchain transfer can be reversed.

ATAI Coin and referrals

ATAI Coin is a platform loyalty reward, not a cryptocurrency investment, deposit, security or claim to cash. Eligible product purchases and referral activity may earn rewards under the rules shown in your account. Rewards may be redeemed only for eligible ATAI products at the value and conditions shown before checkout. They cannot be purchased, sold, transferred to another member or withdrawn as money or cryptocurrency.

Each member has one referral link. The first valid recorded referrer is attached to the referred account for eligible future purchases across products. Referral commissions are paid in ATAI Coin rewards, not cash. Free orders and orders paid with coins do not generate further purchase or referral rewards. Cancelled or reversed transactions, fraud and abuse may lead to related reward adjustments.

Do not create false accounts, self-refer through duplicate identities, misrepresent the service or promise investment returns when sharing a referral link. Disclose your referral benefit where required. Material changes to reward rules will be communicated and applied subject to applicable consumer law.

Acceptable use and intellectual property

Do not access another person's data, probe or disrupt the service without permission, upload malicious content, commit payment or referral fraud, impersonate others, or redistribute restricted data or software without permission. Respect third-party data licences and use only content and accounts you have a right to provide.

ATAI and its licensors retain rights to the software, brand and service content. You retain your rights in your notes, charts and other material. You authorise us to process and display that material as needed to supply the functions you use, secure the service and meet legal duties, as described in our Privacy Policy. Your private journal is not made public simply because you use the service.

Availability, suspension and changes

Services may be interrupted for maintenance, provider failures, security incidents or other operational reasons. We may limit or suspend access where reasonably necessary to protect the service, investigate abuse, address unpaid orders or comply with law. We will provide notice where practical and legally permitted. Mandatory remedies for services not supplied remain available.

We may update features and these Terms. The effective date is shown here; material changes will be communicated where required. A later update does not erase rights accrued under an earlier purchase. New consent will be requested when required, including at checkout for the applicable terms version.

Disclaimers and limitation of responsibility

To the extent permitted by applicable law, the software and services are supplied on an “as is” and “as available” basis. ATAI does not guarantee uninterrupted or error-free operation, compatibility with every broker or system, or any particular trading result. You must independently verify information and supervise any automation you choose to run.

Nothing in this agreement excludes mandatory consumer rights or liability that cannot lawfully be excluded. Acceptance of trading risk does not waive ATAI’s non-excludable legal obligations.

To the fullest extent permitted by applicable law, LUMINOVA AI TWIN INC., its directors, employees and contractors are not liable for trading losses, loss of expected profit, market opportunity or consequential loss arising from your use of or reliance on the tools, market movements, broker execution or third-party interruptions. This does not exclude liability for fraud, wilful misconduct, gross negligence where it cannot be excluded, or any duty, warranty or liability that applicable law makes non-excludable.

Nothing here limits mandatory consumer or privacy rights, prevents a lawful complaint to a regulator, or treats your acceptance as a waiver of our legal obligations. If a provision is unenforceable, it applies only to the lawful extent and the rest of the Terms continue to operate.

Questions and disputes

Please contact support@atai.ca so we can investigate a concern and seek a practical resolution. Applicable mandatory law, including consumer protections available in your place of residence, continues to apply. These Terms do not require you to waive a non-excludable right to bring a claim or complaint in a legally competent forum. Keep your order confirmation and the terms version provided with your purchase.
